Thank you for being a part of the Bruegger’s Enterprises, Inc. (“Bruegger’s”) Coffee & Bagel for a Year Giveaway (“Giveaway”). We are very excited to celebrate our new partnership with Caribou Coffee® with this launch day offer, because the best bagels deserve the best coffee and so do you.
On the designated Coffee & Bagel for a Year Giveaway event day, Wednesday, November 7, 2018, the first 50 (Fifty) registered guests (“Participants”) in line outside the bakery Omaha- 132nd & West Center bakery at 12989 West Center Road at opening, 6:00 a.m. Central Time, (“Opening Time”) and in compliance with our Rules (“Rules”), will receive one (1) coupon book containing 52 (Fifty-Two) coupons good for one medium drip coffee and one bagel with cream cheese per week for a year. Prize will be distributed by a Bruegger’s Bagels employee when they enter the bakery. Guests who use the drive thru and do not visit the bakery in person on the event day are not eligible Participants for the Coffee & Bagel for a Year Giveaway (“Giveaway”).
Eligibility: The Giveaway is only offered to legal United States residents with a valid government issued photo ID who are 18 (Eighteen) years of age or older on the day of the Giveaway. Guests under the age of 18 (Eighteen) but over the age of 15 (Fifteen) are not eligible to win a coupon book but are allowed to camp out with their parent or guardian. Guests under the age of 18 (Eighteen) are not allowed to camp out without a parent or guardian present. Employees, contractors, directors, officers, or agents of Bruegger’s Enterprises, Inc., Caribou Coffee, Inc., their respective affiliates, and each of their advertising or promotional agencies are not eligible to participate as Participants in this Giveaway. This Giveaway is not sponsored, endorsed or administered by or associated with Facebook, Twitter, Instagram or Pinterest.
Prizes: The first 50 (Fifty) Participants that comply with the Rules will receive a coupon book containing 52 (Fifty-Two) coupons good for one medium drip coffee and one bagel with cream cheese per week for a year. Participants will be given one (1) of fifty (50) coupon books with an approximate retail value (“ARV”) value of $259.00 (Two Hundred and Thirty U.S. Dollars) each. All prize distribution excludes guests using any bakery drive thru. Guests will receive their prize from a team member when the bakery opens at Opening Time.
Registration: The first 50 (Fifty) guests who are 18 (Eighteen) years of age or older that are in the designated line at 6:00am CST when the bakery opens will be considered registered Participants. Any participant who leaves the line prior to bakery opening and distribution of coupon books will forfeit their registration. Participant registration will close when 50 (Fifty) people have received their coupon booklet following bakery opening. Participants agree to follow these Rules in their entirety or will forfeit their prize. Anyone who does not follow the registration requirements will be disqualified, forfeit their spot in line and will not receive the coupon book prize.
Rules:
Pets and animals (except service animals) shall not be permitted at the bakery during the Giveaway. No illegal drugs or alcohol are permitted at the bakery at any time. Anyone under the influence of alcohol or illegal drugs will be disqualified from the Giveaway and be required to leave the bakery immediately.
Brueggers shall have no obligation to provide shelter, clothing, food, drink or any other item to any Participant or guest. The foregoing items are the sole responsibility of the Participants or guests. Participants and guests must dress appropriately for changing weather conditions. Bruegger’s team members may conduct random checks of Participants during the Giveaway to confirm adherence to these Rules. If a Participant or guest is found to have violated any Rules, including without limitation, leaving the designated area at the bakery, Participant may, at Bruegger’s sole discretion, be disqualified from receiving a coupon book. Participants and guests agree to abide by all safety and decorum conditions established by Bruegger’s and may be immediately removed from the bakery at the sole discretion of Bruegger’s, for failure to comply with said conditions, or for any reason at Bruegger’s sole discretion. Bruegger’s reserves the right to, in their sole and absolute discretion, not award a Prize to any Participant. Bruegger’s is not responsible for any Prizes that are lost, stolen or misplaced.
General Conditions: All federal, state, and local laws and regulations apply. Neither Bruegger’s, Caribou nor any other Released Party (defined below) is responsible for lost, late, incomplete, stolen, misdirected, illegible, or incomplete entries, or for any incorrect or inaccurate information, whether caused by Participating Parties, tampering, or by any of the equipment or programming associated with or utilized in the Giveaway, and Bruegger’s nor any Released Party assumes responsibility for any error, omission, defect, theft, destruction, or unauthorized access to the materials related to the Giveaway. Bruegger’s reserves the right, in their sole discretion, to disqualify any Participant found to be tampering with the entry process or the operation of the Giveaway, to be acting in violation of these Rules, or to be acting illegally or in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. In such event(s), Bruegger’s reserves the right (in addition to disqualification of such Participant) to seek damages from any such Participant to the fullest extent permitted by law. If, for any reason, the Giveaway is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, actions by persons, weather, acts of God, fraud, or any other causes which, Bruegger’s, in their sole opinion, deems could corrupt or affect the administration, safety, security, fairness, integrity, or proper conduct of the Giveaway, or the Giveaway is otherwise not capable of running as planned, Bruegger’s reserves the right, in their sole discretion, to cancel, terminate, modify, or suspend the Giveaway. If the Giveaway or any portion of the Giveaway is terminated before the end of the Giveaway, Bruegger’s may, in their sole discretion, elect to award Prizes to any or all Participants. In the event that a Prize cannot be awarded for any reason, or if a Participant is not capable of redeeming the Prize for any reason, Bruegger’s shall not be obligated to award any such Prize, and Bruegger’s reserves the right, in their sole discretion, whether or not to substitute a Prize (or portion of Prize) with a prize of comparable or greater value or cash value. If, for any reason, more than the stated number of Prizes are available and/or claimed, Bruegger’s reserves the right, in their sole discretion, to award more than the stated number of Prizes. An individual will not win a prize until he or she has fully complied with these Rules. A Prize is not exchangeable for cash, merchandise, or services except as stated on the Coupon. No groups, clubs, newsletters, or organizations may reproduce or distribute any portion of these Rules to their members, and anyone who participates in the Giveaway through means not permitted by these Official Rules is subject to disqualification.
Release: By participating in this Giveaway, the Participants agree to release, indemnify, and hold harmless Bruegger’s Enterprises, Inc., Caribou Coffee Company, Inc., their respective affiliates, any applicable promotional or advertising sponsors and each of their respective employees, officers, directors, agents and contractors (the “Released Parties”) from any and all liability for any injuries, loss, harm, damage, cost, or expense of any kind to any person(s), including, without limitation, property damage, personal injury, and/or death, arising in whole or in part, directly or indirectly, from acceptance, possession, use, and/or misuse of a Prize, participation in this Giveaway or any Giveaway-related activity, being present at the Store for the Giveaway, and for any claims based on publicity rights, defamation, or invasion of privacy.
Indemnification and Release of Facebook, Twitter, Instagram or Pinterest: You acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or Pinterest. You agree to release Facebook, Twitter, Instagram or Pinterest from all liability relating to this promotion. You will indemnify and hold Facebook, Twitter, Instagram or Pinterest harmless from and against all damages, losses, and expenses of any kind (including, but not limited to, reasonable legal fees and costs) for any claim related to the promotion including without limitation the publicity or administration thereof.
Limitation of Liability: Except where prohibited, the Participants agree that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Giveaway, or any Prize awarded, or the determination of a Winner, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) under no circumstances will the Participants be permitted to obtain awards for, and the Participants hereby waive any and all rights to claim punitive, incidental, consequential, and any other damages, other than for actual out-of-pocket expenses, and Participants hereby waive any and all rights to have damages multiplied or otherwise increased.
Agreement to Official Rules: By participating in the Giveaway, each Participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Caribou & Bruegger’s (including but not limited to Caribou & Bruegger’s employee(s) handling Prize awards), which are final and binding in all matters relating to the Giveaway. By participating in the Giveaway, each Participating Party waives any right to claim ambiguity in these Official Rules. The failure or delay by Caribou & Bruegger’s in enforcing any particular clause, provision, or aspect of these Official Rules shall not impact the validity, enforceability, or effect of such clause, provision or aspect, or any other clause, provision, or aspect of these Official Rules.
Choice of Law: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Participating Parties and/or Caribou & Bruegger’s in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Minnesota without regard to conflicts of law/choice of law doctrine of Minnesota or any other jurisdiction, and all proceedings shall exclusively take place in the United States District Court in Minnesota, or Minnesota State Court located in St. Paul, Minnesota. The Participating Parties agree to the jurisdiction of such courts and waive any right to change of venue or any like right.
